The following Terms and Conditions apply to all orders which are processed by A W Myhill & Son Ltd either online or by any other form of communication and form part of the contract between us.

Prices

All prices include VAT. No contract is created until we process your order and in the event that a price is incorrect due to a typing error or incorrect information supplied to us by a manufacturer we will not go ahead and process your order.

We will inform you of the correct price of the goods and you will then have the opportunity to confirm with us that you wish us to proceed with the order.

No order will be processed without authority from you if the price is incorrect.

Ordering

After you have selected the product or products you wish to purchase you can select whether you wish to have your items delivered or whether you wish to collect them. If you wish to have them delivered choose the BUY IT NOW button and if you wish to collect them choose the CLICK & COLLECT button.

For the BUY IT NOW option you will find that there is an individual charge for delivery per item and that this will appear in the basket when you choose the item you wish to purchase. This charge is applicable if your order is under £100.00 or you live outside the allotted Norfolk NR postcodes. You can check your postcode on the button below the basket total when you 'Click here for FREE Norfolk delivery'.

If you wish to collect your item from one of our stores yourself then by using the 'Click and Collect' button you will cancel any delivery charges. You will then be contacted by us to arrange a convenient time for you to collect. If we have to order the item in for you then we will let you know the expected delivery day to us from the manufacturer as soon as we can and a deposit may be required. We will not process your order until we have confirmed with you that this is satisfactory to you. No payment will be taken until this confirmation has been made.

Delivery

You may benefit from a fast delivery service if you live in a NR postcode(Please check at the 'basket' if this applies to you).If we have stock of your products then our delivery service is likely to be within 5 working days and daily to AM or PM delivery slots. We are unable to deliver on a Saturday. We also offer an optional installation service if applicable. If we have to order the product then we will anticipate to let you know as soon as possible when your delivery is likely to take place.

If you do live out of the NR postcode area then we will use a carrier or manufacturer to deliver to you and unfortunately at this time we do have to charge for this service. We do however offer you the same service as we offer our local customers and we aim to be available to you for the lifetime of your product. We deliver to the British Mainland (Not including Northern Ireland, Channel Isles or Isle of Man) and this is subject to delivery service confirmation from our carriers and/or our manufacturers. We will alert you immediately if we are unable to cover your area and no payment will be taken.

If the item is out of stock at our suppliers then we will keep you updated with any progess via either email or telephone

If you would prefer to have a Saturday delivery for these items we can arrange this, where possible, for you at an extra cost. Email sales@awmyhill.com for a quotation.

Please Note: As we do use third party delivery services to reach outside our store areas and they are unable to accommodate some heavy items such as Large Widescreen and Plasma TVs. These are only available for purchase in store and delivery in the immediate local area. All deliveries must be signed for.

The delivery charge stated covers a one man, ground floor delivery to your doorstep, in some cases we can offer a comprehensive two man service, but this service could incur extra charges. If you wish to discuss delivery, please contact us on 01953453107. Should the driver offer to assist into the property with your goods we cannot be held responsible for any damage incurred to either your goods or the property. It is your responsibility to ensure that you have signed for the correct number of goods delivered. Failed deliveries will incur an additional delivery charge if you are not present on the agreed delivery date – this charge may vary as we subsidise our delivery charges

Payment

Payment will be taken when we ring you to confirm the order if you require us to deliver your goods. Payment will be taken for Click and Collect in store at time of collection unless the item is a special order and in this instance we will ring you to confirm your order and a deposit payment may be required.

A contract between us is not formed until we have processed the transaction and started the dispatch process. We accept payment by most major credit and debit cards or cleared fund cheques and bankers draft.

Credit card orders are notified as soon as possible if they are successful or not and the option to pay in other means will be communicated by telephone to you.

Can I pay by credit card and have the goods delivered to an address other than the invoice address? No, unfortunately due to security reasons we can only deliver goods to the credit card billing address, if you wish to have goods delivered elsewhere you would have to pay by cheque, bank transfer or some other means of cleared funds first.

Installation

In the Norfolk area subject to your postcode we deliver, disconnect old and install most items ourselves, and also take old appliance away free of charge. Choose the installation type within the "shopping basket" area of your order. Unlike some companies all items are even installed FREE of charge by ourselves.

Installation includes unpacking the product, setting it up and demonstrating. It also includes removing and recycling any packaging.

Accessories, leads etc can also be purchased separately and some will be held on our delivery van at time of delivery. We are currently unable to offer our own installation service to other areas. However, some of the manufacturers will install and dispose of old items when they deliver so please enquire on Tel 01953453107 for a quotation.

This is again subject to postcode.

Flats & multi dwelling buildings - From the 1st January 2008 all gas cooking appliances for use in flats and other multi dwelling buildings can not be installed unless they are fitted with a flame failure device. It may not be clear from an address that you are in this type of property. If you are living in a flats or multi dwelling building you must ensure the appliance you order is fitted with this device.

All Electric cookers require a minimum 30amp cooker socket.

Wet appliances (washing machines dishwashers) require a standard cold water feed, drain outlet and 13amp plug socket within 1m of the appliance.

American Fridge Freezers with Ice and Water dispensers require a standard cold water feed and 13amp plug socket within 1m of the appliance.

Guarantee

All products are supplied guaranteed for a minimum period of one year following the date of delivery unless otherwise stated or an extended promotional guarantee is offered via a claim form by the manufacturer.

Sales & Service Working Hours

Our normal office hours are 8.30am - 5.00pm Monday - Saturday.

The Directive

The waste electrical or electronic equipment (WEEE) directive requires countries to maximise separation collection and environmentally friendly processing of waste electricals.

In the UK, that means retailers like us must offer all customers buying new equipment Free take back for their old electricals.

Returns and Refunds

Your Right to Cancel

We want you to be delighted with your order. If you wish to cancel your order you may do so at any time in writing by post or email from the day you placed the order, up to 7 working days starting the day after you received the goods without reason. A refund of all monies including postage and packing charges, will be made within 30 days of cancellation. Where the goods are not faulty or wrongly delivered by us the goods must be returned at your cost. If you are not able to return the goods can arrange to collect the goods and deduct the direct cost from the refund.

If you wish to return a 'Special Order item' you will incur a 20% restocking charge to cover the return of the product to the Manufacturer in addition to collection charges (as detailed above) to cover transport costs. 'Special Order Items' will be clearly stated on your order.

Please ensure the product has not been used, is returned undamaged in the original packaging with any accessories and any supplied free gifts. Charges will be applied for any factory packed accessories which are found to be missing from the original order and a charge will be deducted from your refund.ie Remote control £40 - £80, Instruction book £10 - £20, Leads £5 - £40 etc. Charges may vary from this and are for guidance only

awmyhill.com reserves the right under The Consumer Protection (Distance Selling) Regulations 2000 not to accept returns of audio or video recordings or computer software, where the consumer has unsealed the goods.

On receipt of your goods from us A W Myhill & Son Ltd, please inspect and inform us immediately of any damages or missing items within 7 working days. This does not affect your statutory rights as a consumer.

Complaints

Any complaints regarding the goods or services supplied should be made to the above address. All complaints will be responded to within 24hrs (during the working week).

Faulty Goods

Claims regarding faulty goods will be subject to the terms and conditions of the manufacturers warranty but this does not affect your statutory rights. If your product appears not to be functioning correctly please first check the manufacturer’s instruction book and follow the fault finding guide.

If a product has been installed the manufacturer will need to send a service engineer to inspect the appliance to establish the nature of the fault. Please remember if a product is found to be installed incorrectly the manufacturer reserves the right to charge for the service call. When installing a gas appliance a qualified Gas Safe engineer is required, who will have the proper certification.

If your goods develop a fault within 28 days of receipt please contact us to arrange return and inspection. Generally we will exchange or refund the item provided it is 'as new' and has no faults caused by accident, misuse or neglect. You must notify us of any damages or missing items within 7 working days. This does not affect your statutory rights as a consumer.

If your goods develop a fault after 28 days and within its 12 months guarantee we will arrange to repair and return or replace the product to you free of charge.

Refunds are made as soon as possible and in any event within 30 days of your order. A W Myhill will not be obliged to offer any additional compensation for disappointment suffered.

Products

Product images, descriptions and specifications are shown for guidance only; for example cabinet/case colours may vary, TV stands shown may differ from those supplied, remote control designs may vary during manufactures' production run etc. Some products may require set-up and/or assembly; for example TV's, videos and Hi-fi tuners may need manually tuning. TV stands/cabinet stands may need assembly. Washing machines need to have transit bolts removed etc.and it is advised that the instruction book is read before any item is turned on and used.
